By accessing this website you are confirming your acceptance of these Terms & Conditions of Use in full and agree to be bound by them. In making payment of the required deposit to secure a vehicle, date and chauffeur, you are also accepting the Terms & Conditions of Hire and agree to be bound by them. Fabulous Cars Classic Hire ('FCCH' Trading Name in association with Fabulous Flowers) undertakes to hire vehicle(s) to the Client (the person booking and paying for the service) for the period of hire, under the following terms and conditions: Prospective clients may use this website to make contact by telephone or email for further information or prices. We will respond to either request by email or telephone as appropriate, giving a quote based on the information provided. As required, we will negotiate and agree a price for the work the prospective client wants us to do for them. We will then agree a payment method (sending an email confirmation if requested). Payment must be;
  1. A booking fee (Non Refundable) to be paid of £100 per car at the time of booking to secure the car and booking date. Bookings are not confirmed until a full deposit has been received.

  2. Pre-payment in full to be paid 28 days before the booking date.

  3. Currently NO UK VAT is charged.

  4. We except Cheque's & Cash Payments or Credit Cards via Lloyds Cardnet. (Will show on your bank statement as 'Fabulous Flowers'). We also accept Faster Payments (BACS). Make your cheque payable to 'Fabulous Cars'.

  5. Any variations to the journey(s) originally discussed, booked and agreed to between FCCH and the Client may be subject to additional charges, if these changes involve extra time and or distance being covered. (This charge will be £30.00 per every extra half hour or £50.00 for the full hour).

  6. No hidden taxes, fees or extra charges will be payable upon completion of the job, except where additional waiting time and or car parking charges have been incurred and these were defined and agreed to in our quotation discussions, or as defined under paragraph (5) above.

  7. When a prospective client wishes to go ahead on the basis of the quotation given and the payment method agreed, they will confirm their reservation by paying the appropriate booking fee. It is the responsibility of The Hirer to verify that the published details, dates, times and addresses are correct on the ‘booking details’ form. The booking is accepted based on the times and itinerary stated.

  8. We reserve the right to alter our charges in extreme circumstances, however prices are fixed at the time of booking. See paragraph 27 for further details.

  9. We reserve the right to substitute any vehicle or chauffeur/driver. Every care is taken to maintain this vehicle in first class condition but in the unlikely event that the car is not available, due to accident or breakdown, FCCH reserve the right to substitute the car to The Hirer’s satisfaction, giving as much notice as possible. If such a substitution (as stated) is not possible, the liability of FCCH shall be strictly limited to the refund of hire charges paid under the terms of the booking. FCCH will not be responsible for any consequential indirect loss.

  10. Without prior notice : FCCH  reserves the right to amend, change, delete or add to these terms and conditions when necessary.

  11. In the event of a "No-show" by the client, or if a booking is cancelled by the Hirer after the 28 days cut off point then all monies paid will be totally non-refundable.

  12. If a booking is cancelled by the Customer prior to 28 days of the start of the period of hire, any deposits paid will be lost, other payments - 50% will be refunded. This does not include any other sub-contracted related services payments. Cancellations must be received in writing (This is a safeguard to both parties). The full outstanding balance is due if the cancellation is received within 28 days of the booked date.

  13. Every effort will be made by FCCH  to make sure that the vehicle(s) arrive on time and reach destinations on time too. FCCH shall not be held responsible or liable for any delays (and/or arising consequential losses) that occur beyond its control. Although we will endeavour to meet deadlines we accept no responsibility for any delays, however caused. No responsibility can be accepted for adverse weather conditions (i.e. snow, flooding, etc.) which may cause delay or cancellation of a booking by FCCH. On arrival at the collection point the Chauffeur will make the Bridal Party aware of his arrival. Please note that passengers should make themselves available at the requested time. It is not the Chauffeur's responsibility to search for passengers.

  14. The Chauffeur will travel by the most appropriate route on the day, unless instructed otherwise by the Customer when term (5) may apply.

  15. Although vehicles are fully insured for passenger and third-party claims under British Law, Customer's properties are carried entirely at their own risk and FCCH shall not be held responsible/liable for any loss/damage to such property.

  16. FCCH  and its Chauffeurs have the right to refuse to carry any passenger who is thought to be under the influence of alcohol or drugs and whose behaviour poses a threat either to the Chauffeur, the vehicle or any other passenger. The Hirer is responsible for the conduct of all passengers. The Driver may terminate the booking if The Hirer or passengers cause excessive delays, are disorderly or, in the opinion of the Driver, are unfit to travel.

  17. FCCH maintains a strict non-smoking policy in all its vehicles. It is now a legal requirement that passengers  or the drivers are NOT allowed to smoke in the vehicles.

  18. Nothing contained in these terms and conditions can affect the Client's' statutory rights.

  19. All prices quoted are based on a three-hour hire, unless otherwise stated. Where a hire exceeds this time, we reserve the right to charge a waiting time for each car. This charge (£30.00 every extra half hour, £50.00 for the full hour) and will be payable to the driver directly or with prior notification by a holding cheque.

  20. If the hire exceeds the booked time, or is likely to exceed the booking time after completion of the itinerary, the driver(s) may at their discretion and after warning the client or the clients representative take their leave if the client chooses not to pay any additional charges in term (20) Or if the car is required for another booking - term (22).

  21. It is not FCCH policy to book a vehicle for more than one event per day, but where a booking may constitute only part of a day i.e. an afternoon, FCCH may hire out the same vehicle in the evening for a second booking. Where this happens, FCCH will allow a 2 hour gap for the car to come back to the garage before going out again.

  22. Where payments are made by cheque, we reserve the right to charge an administration fee of what the bank will charge us for any cheques returned by our bank to us for whatever reason.

  23. All of our drivers are 'CRB checked'. Where this may be a requirement when vulnerable passengers are travelling in vehicles, please tell us at the time of booking and we will try to accommodate this requirement.

  24. With the change in the law on September 18th 2006, we would draw our clients attention to the height age requirements as regards the law. The following site may be of help... http://www.childcarseats.org.uk/ as the details at the time of booking tend not to include age and height of minors, it is the hirers responsibility to alert our staff that special seating requirements will be required to convey their guests in a safe and legal manner. The appropriate equipment may be free issued by the client at no additional cost. Children travelling in the vehicles must be accompanied by an adult at all times.

  25. A Booking Fee is defined in this agreement as 'a payment given as a guarantee that an obligation will be met by the client '. Bookings are accepted only on the understanding that The Hirer understands and accepts the above terms and conditions and payment of the deposit signifies such acceptance.

  26. In the event that fuel charges, road mileage charging, car road fund license or any other government taxation system comes into force in between your booking and the commencement of service, we reserve the right to re-negotiate the cost of the service to you. In the event that agreement cannot be reached, all monies paid by the client will be fully refunded out with terms 12 and 13 above. This would typically be a rise in costs greater than 10% for a booking made less than a year in advance.

  27. The Hirer shall be fully responsible and liable for any damage caused to the vehicle (interior or exterior) by The Hirer or any member of his/her party, howsoever caused.
  28. Complaints Procedure: Placed in writing only by the hirer - note this cannot be dealt over the telephone.
